Terms of Service

Capitalized terms used in these Terms have the following meanings:

• Template: Pre-designed graphic layouts available through our Service for customization and rendering.
• Service: The Effects.gg platform, including rendering tools, website, APIs, and related features.
• Rendered Designs: Final output files (e.g., images, videos) generated by users using Templates on the Service.
• Effects.gg: Refers to the company and platform operating the Service (Business ID: 3350034-3, Finland).
• Free License Agreement: The license granted by Effects.gg allowing limited use of Rendered Designs under specified conditions.
• User-Generated Content: Text, images, or other materials uploaded or input by users to customize Templates.
• Stripe: Third-party payment processor used for one-time purchases on the Service.

2.1 Age Requirement: The Service is available to individuals aged 13 years or older.

3.1 Purchases: Paid Templates are available for one-time purchase via Stripe.

3.2 Taxes: All prices include VAT where applicable. Users outside the European Union are responsible for complying with applicable local tax regulations.

4.1 User-Generated Content: You retain ownership of any text, images, or materials you upload to customize Templates.

4.2 Effects.gg Intellectual Property:

• All Templates, software, and Rendered Designs remain the exclusive property of Effects.gg.
• Use of Templates and Rendered Designs is governed by our Free License Agreement.

4.3 Third-Party Content: You warrant and represent that any content you upload does not infringe third-party rights.

5.1 Rate Limits:

• Users may generate up to 15 Rendered Designs per hour per device/IP address.
• Circumventing these limits (e.g., automated tools, distributed networks) is strictly prohibited.

5.2 Prohibited Activities: You agree not to use the Service to:

• Upload or process content that is unlawful, infringing, or harmful;
• Reverse-engineer, decompile, or disrupt the Service’s infrastructure;
• Engage in excessive automated requests or data scraping.
• Exclusions may be made as per our Vulnerability Disclosure Policy.

6.1 Service Provided "As Is": Effects.gg makes no warranties regarding uninterrupted availability or error-free operation.

6.2 Limitation of Liability:

• To the maximum extent permitted by Finnish law, our liability for direct damages is limited to the amount you paid for the Service.
• We are not liable for indirect, incidental, or consequential damages.

6.3 Statutory Rights: These terms do not affect your statutory rights under Finnish consumer law.

7.1 Reporting: To submit a copyright infringement claim, email [email protected] with:

• Identification of the disputed content;
• Your contact details and a statement of good faith.

7.2 Action: We will expeditiously remove access to content found to infringe third-party rights.

8.1 Updates: We reserve the right to revise these Terms. Material changes will be announced via a website banner for 30 days.

8.2 Continued Use: Your ongoing use of the Service constitutes acceptance of revised Terms.

9.1 Jurisdiction: These Terms are governed by the laws of Finland.

9.2 Dispute Resolution: Any claims shall be resolved exclusively in the Uusimaa District Court in Helsinki.
